What to Do If Your Ex Is Harassing You During Divorce

Going through a divorce is tough enough, but when you add a harassing ex into the mix, things get more complicated. Constant phone calls, threatening messages, and showing up unannounced at your place are some of the things that people face. All of this can create more stress during an already overwhelming time.

Thankfully, there are ways to deal with such situations effectively. First of all, you must be able to recognize the harassment. In Massachusetts, people experiencing harassment can apply for a restraining order or take other legal steps for protection. However, to do this, you will need to understand the legal procedures.

As you are already in an emotionally draining situation, the last thing you need is additional harassment. It is best to consult with a skilled Massachusetts divorce lawyer to know the legal options for your situation.

Steps to take if you are being harassed

  1. Stay calm and protect yourself.

If your ex-partner is harassing you during divorce, first, make sure you stay calm. If you do not control your emotions and act in anger or frustration, it will only make the situation worse. No matter how much your ex is provoking you, you should not react to it.

Take deep breaths, walk away from the situation, and give yourself time to think. If your ex physically threatens you, make sure you keep a distance and find a safe space for yourself.

It is very important to keep your phone charged so that you can share your live location with your friends or family when you feel comfortable.

  1. Set clear boundaries.

You must set clear boundaries with your ex for your safety. Tell them clearly that you do not want to participate in any unnecessary conversation, like personal discussions. Only talk to them on serious matters related to divorce, child custody, and so on.

You can also hire a mediator or a lawyer to avoid directly contacting your ex. In some cases, where communication is unavoidable, set strict limits on how often your ex can contact you.

  1. Seek legal advice.

If you are a victim of harassment, it is very important to talk to a divorce lawyer. These professionals can help you understand your legal rights and tell you about your available options. They can guide you on how to handle the situation and may also suggest you file for a protection order for your safety.

They will help you collect evidence that will make your side stronger and increase your chances of winning the case. You should never underestimate the power of a divorce lawyer, especially when you are dealing with a violent ex.

  1. Restraining orders and protection orders.

If your ex is constantly bothering you, the law gives you the right to file a protection order, also known as a restraining order. This order will prevent your ex from coming near you or even contacting you.

If the harassment becomes very serious, such as when your ex starts giving death threats, you must file for a restraining order immediately. For this, you will need to go to court and provide evidence of harassment. This may include text messages, call recordings, and even witness statements.

  1. Contact law officers if necessary.

Harassment with physical violence is a criminal act and is punishable under the law. Calling the police officers will allow them to act quickly and stop the situation from getting worse. Make sure you keep all the logs of the harassment and show them to the police. The police will also create a report that can provide solid evidence for your case.

Need help dealing with harassment?

When you find yourself in a situation where an ex-partner is harassing you, you may feel frustrated and confused about your options. To handle your divorce smoothly and get protection orders, consult with a divorce attorney today!
